WhatsApp Business 2026 年 9 月條款更新：診所需要注意的六件事

一、繼續使用即視為同意

9 月 23 日後繼續使用 Business App，即代表接受新條款。如不同意，須刪除帳戶並停止使用。（Business App 條款第 17 條）

“Company's continued use of our Business App Services confirms its acceptance of these Business App Terms as amended.”

二、WhatsApp 不保證 Business App 適合醫療機構

條款列明，WhatsApp 不保證 Business App 符合醫療、金融、法律等對個人資料有較高保密要求的機構的需要。使用是否合法，由企業自行負責。（Business App 條款第 4 條）

“We make no representations or warranties that our Business App Services meet the needs of entities regulated by laws and regulations with heightened confidentiality requirements for personal data, such as healthcare, financial, or legal services entities.”

三、不可經 WhatsApp 索取身份證號碼

WhatsApp 商業政策禁止在 WhatsApp 分享或要求對方提供身份證號碼等敏感識別資料。如當地法規有所限制，亦不可用 WhatsApp 傳送或索取健康相關資料。這項政策同時適用於 Business App 和 API。（Messaging Policy 第 3 節）

“Don't share or ask people to share … personal ID card numbers, or other sensitive identifiers.”

四、病人封鎖或舉報可引致封號

WhatsApp 會參考用戶封鎖及舉報的紀錄，判斷企業有否違規，並可限制、暫停或終止帳戶。收到過多負面回饋，本身已可構成理由。（Business App 條款第 6 條及第 12 條）

“We have the right to limit, throttle, suspend, or terminate Company's account.”

五、被終止後不可自行開新帳戶

帳戶被終止後，未經 WhatsApp 書面許可，不可另開商業帳戶。商業政策亦列明，WhatsApp 可禁止違規機構日後使用其所有產品。（Business App 條款第 6 條及 Messaging Policy 第 7 節）

“Company will not create another WhatsApp business account without our express written permission.”

六、醫療及保健產品屬受規管類別

藥物及醫療保健產品屬受規管類別，Business App 完全禁止發送相關訊息。一般預約及覆診提醒不在此列，但如用 Business App 推廣或售賣藥物、保健品，便須留意。（Messaging Policy 第 4 及第 5 節）

“You are prohibited from messaging about any Regulated Verticals on the WhatsApp Business App.”

診所可以先檢查的地方

• 有沒有在 WhatsApp 要求病人提供身份證號碼
• 有沒有經 WhatsApp 傳送報告或化驗結果
• 診所帳戶是否只由獲授權職員使用，手機有沒有上鎖
• 有沒有經 WhatsApp 推廣藥物或保健品
• 病人是否同意接收提醒或推廣訊息
• 有沒有給病人拒絕接收訊息的選擇

這次更新把 Business App 和 API 的條款分開。對診所來說，較需要留意的有幾點：使用是否合法由診所自行負責，病人的封鎖和舉報會影響帳戶，而帳戶一旦被終止，未經 WhatsApp 許可不能另開新帳戶。建議診所按上面的清單檢查現時的做法，有需要時再作調整。
